The Council of Europe (COE) thinks they are, explaining that NGO ‘captains’ can disembark illegals without approval from the nation-states.
The COE often slips below the radar but it is a radical organization of unelected cultural Marxists. It is home to the ECHR (Soros Court) and the designer of the poisonous Istanbul Convention and its gender-identity nonsense.
No reason for any European nation-state to remain in this sect.

on NGO ships facilitating illegal migration and their actions that willfully break the law.
The reason for the letter was a meeting of the Committee on Civil Liberties, Justice and Home Affairs (LIBE) on the 15th of March. The meeting concerning search and rescue operations in the Mediterranean. During the meeting, Dunja Mijatović, Commissioner for Human Rights of the Council of Europe made some shocking statements.

“During the meeting, Commissioner Mijatović literally said that the captains of these ships may even refuse to comply with the instructions from the Member States, and proceed to their ports”, said Fidesz MEP Balázs Hidvéghi. In other words, according to the Commissioner, NGO vessels can land illegal migrants collected in the Mediterranean on the basis of human rights concerns even against the will of the respective Member State and in violation of their laws.

Unfortunately, based on past actions, it is clear where the EU stands on this issue.
When Matteo Salvini challenged the NGOs regarding illegal migration, the entire EU establishment attacked Salvini…and not the NGO traffickers.
